Abstrakt		The author defines the doctor as basis primary carrier of medical activity and regarding to this the possibility of making the professional mistake. He shows the preconditions that have to be fulfilled to enable the qualification of a doctor's action as professional mistake. He also names the circumstances that exclude a professional mistake by the doctorand by this also doctor's liability in spite of the emergence of damage for the patient.
