Abstract		The essential questions judges are concerned with are whether offenders were under the influence of drugs at the time when they committed criminal actions and what was the type of that influence. Another set of questions to which court experts in psychiatry must reply is whether the persons in question were able to understand the meaning of their actions or not, and whether they could control them. The findings of experts as to whether a violation was the case of drug use, abuse or addiction is important. In addition to the diagnosis of narcotism, the question of whether it is sensible to order compulsive treatmeM as a punitive measure will also need to be answered. Due to the poor motivation of addicts, the success of treatment is usually also poor and instih?ting the measure of compulsory treatmeM senseless. The treatment of mental illness is appropriate 'rf it coexists with drug addiction. All Articles from the Criminal Code of the Republic of Slovenia related to dru addiction are collected in the paper.
