Abstract     The worst types of errors in medicine are classified in our criminal law as special criminal activities. The Penal Code of the RS from 1994 includes the following types of criminal activities: failing to provide medical assistance, negligent treatment, illegal transplantation of human body parts and the giving of false medical testimony; it does not include many types of quackery as types of criminal activities. In order to clarify the actual situation the courts will require the opinion of medical experts; the opinions should be given by teams of specialists in the same field as the doctor who is alleged to have performed the criminal activities, together with a specialist in forensic medicine.
