Abstract     ln the contribution the authors give a presentation and an analysis of the legislation of the Republic of Croatia that was passed in the framework of the reform of the health care and health insurance system (from 1990 till 2002), from the aspect of the right to health protection and the patient's rights from the analysis of positive health legislation derives that the range and level of the right to health protection created in the frame ot the compulsory health insurance are reduced in comparison with the state as it was in the period from 1980 till 1990. Meanwhile, the authors conclude, beside the circumstance that in Croatian society the consciousness of the meaning and the value of personal human rights, to which the patient's rights belong, increased, and the circumstance that Croatian citizens as patients pay an increasing share of health services, puts them in the position of a buyer - the decrease of the social right to health protection stimulates the strengthening of the demand for the modernisation of the patient's rights and the creation of effective mechanisms for their protection.
