Abstract     This contribution analysis the thesis that the right of insured people under the Health Protection and Health lnsurance Act are not properly regulated. The article establisher that the type and contents rights to medical services connected to diagnostics and therapy are regulated in autonomous acts passed by the Health lnsurance lnstitution of Slovenia. Proceedings of the protection of the rights to medical services are not expressively regulated. Since the rights to medical services are based on constitutional provisions on the human rights, they should be regulated by an act, regarding from the material-legal and formal-legal view. The regulation in an act would have positive legal consequences for the insured people and for the carriers of health activities, as well.
