Abstract     In the Republic of Slovenia, there are no detailed statutory regulations on the collection of biological samples intended for the analysis of the basic genetic material of a living person without his/her consent and against a person in cases where there are justified grounds that this person committed a criminal offence and where, by such analysis, data necessary for carrying out a successful process will be obtained. In the middle of the 1980s, the development of molecular biology and DNA analysis enabled a new level of quality for forensic medicine in recognising biological traces. The discovery of DNA's useful value signified huge progress in the quality of forensic work in the field of criminal and civil legal procedures. In forensic and legal practice, previous work has indicated the necessity to adopt appropriate and detailed rules to regulate the method for collecting biological samples intended for DNA analysis. The draft of the rules will be precisely presented in the continuation.
