Abstract     The legal definition of medical error is determined by theory and practice (in the penal code and in civil law) in each country. In Slovenia, both have remained at a general state level and lag behind developments made in Europe over the last half-century. The underlying principles of future legislation will have to be adjusted to follow European legislation in form and content; if this does not happen, the rights and the penal system will lag behind the established standards and become a cause of constant discontent among those concerned when compared with foreign examiples. This will become particularly abvious when the precendent cases emerge in conflict with our established theory and practice, not only in penal law but also in newly-developed insurance relations.
