Abstract     Punishable medical error is a small part of the range of possible professional errors during the interdisciplinary and stage-based treatment process (TP), which comprises diagnostics, therapy, medical care and rehabilitation. The fulfilment of structural and procedural standards in public health organisations ensures a safe and high-quality TP. The internal protective mechanisms in hospitals comprise supervision, consultation, direction, counselling, analyss, the standardisation of procedures, autopsies, and special technical protective systems. The doctor is responsible for the TP and participates in most internal protective mechanisms. The financial problems of the public health system, however, have a great impact on the organisation of the working process; they impose certain limitations (equipment, staff, diagnostics, therapy) and demand increased efficiency. The educationa. research and publishing obligations of doctors impose additional limitations on the time devoted to work with patients and to participation in internal protective mechanisms. The doctors first come into conflict with professional ethics, and finally become indifferent civil servants. Interpersonal working relations suffer, and the attitude towards the patients becomes impersonal and stern. At this point, external protective mechanisms appear, which are mainly repressive and are triggered by the mistreated patient. The management of health organisations must therefore warn the government in good time that the TP under threat. It is essential that the standards for the protection of the TP are legally defined, which should prevent the payer of medical services from crossing the treshold of TP safety and quality because of injustified savings. Moreover, the payer should be obliged to include in the price of the service the costs of legally prescribed internal protective mechanisms.
