Abstract     According to the legislation in force in the Republic of Slovenia, autopsies may be performed on both a mondatory and a permission basis. Mandatary autopsies are defined in the Law on Medical Activities and the Regulations on the Conditions and Methods of performing Post Mortem Examination Services. Autopsies can be performed by both pathology or forensics specialists, who in such a manner determine the medical state of changes in disease among the deceaed, as well as establishing potential erros which may have occurred during the treatment process as a consequence of negligence, ignorance or either anticipated or unexpected complications in the treatment process. In the paper the authors describe the role of the autopsist in dealing with medical error on the basis of the casuistry of the Institute of Forensic Medicine.
