Abstract | Everyone has a right to autonomy regarding medical interventions interfering with his or her physical and mental integrity. This is among the central provisions of the European Convention for the protection of human rights and dignity of the human being with regard to the application of biology and medicine (the Oviedo Convention). The Convention enshrines the principle that, in obtaining consent to medical intervention, the opinion of minors shall be regarded as an increasingly determning factor in proportion to their age, maturity and capacity of discemement. Biocemical research on minors is allowed when a number of special conditions are fulfilled, and if the children involved do not object. Research from which direct benefit to their health cannot be expected, is only exceptionally permissible, i.e. if it entails no more than minimal risk and minimal burden for the individuals concerned. The notion of minimal risk and minimal burden is discussed in some detail. In this, the Convention is more restrictive than most other ethical guidelines as well as current practice in many countries. Provisions of the Convention on authorisation by child's legal representative are illustrated on the example of refusal to authorise urgently needed treatment. | |
Summary | Vsakdo ima pravico do avtonomnosti glede posegov v svojo telesno in duševno integriteto. Ta pravica je med osrednjimi določili evropske Konvencije o varstvu človekovih pravic indostojanstva človeškega bitja v zvezi z uporabo biologije in medicine (Oviedse konvencije). Konvencija uzakonja tudi načelo, da otrok sodeluje pri odločitvah o svojem zdravljenju v največji meri, ki jo dopuščajo njegova starost, zrelost in razsodnost. Biomedicinsko raziskovanje na mladoletnih otrocih je dovoljeno pod vrsto posebnih pogojev in če temu ne nasprotujejo. Raziskava, od katere ni mogoče pričakovati neposredne koristi za prizadetega otroka, je lahko dovoljena le izjemoma, to je, če prinaša minimalno tveganje in minimalno obremenitev. Formulacija minimalnega tveganja in minimalne obremenitve je obrazloženo podrobneje. V tem je Konvencija strožja kot večina etičnih smernic in sedanja praksa v mnogih deželah. Določbe Oviedske konvencije o nadomestnem soglasju ilustrira avtor na zgledu zavrnitve soglasja zakonitega varuha k nujnemu zdravljeju otroka. | |
