Abstract     The author discusses the position of rescuer physicians when they work within the frame- work of the Mountain Rescue Service of Slovenia. The emphasis is on the civil law aspects of the activities of the Mountain Rescue Service of Slovenia and attention is drawn to the inadequate systemic legislation of April 1998. The article suggests that the organization of these activities should be made uniform pursuant to the Law on Protection from Natural and Other Disasters and the Law on Medical Activities, and that emergency medical aid and the rescue service should be organized within the framework of the Mountain Rescue Service of Slovenia to create a uniform organization. Furthermore, the author discusses the liability of the Mountain Rescue Service of Slovenia and that of the state for damage caused to third parties and the liability for damage suffered by mountain rescue service members during the performance of their duties. The author calls for uniform organization, and warns of the urgent necessity of precisely defining the tasks of the Mountain Rescue Service of Slovenia in ičplementing its legal authorizations. He suggests that state guarantees should not be limited only to more severe forms of respon- sibility for damage to third persons and ehat the state's liability for such damage should be the same as appiies to employees in state bodies when they implement their legal authorizations. The author also advocates objective liability of the Mountain Rescue Service of Slovenia and of the state for damage suffered by participants.
Summary     Prispevek obravnava položaj reševalca zdravnika, ko sodeluje v okviru Gorske reševalne službe Slovenije. Poudarek je na javnopravnem delovanju Gorske reševalne službe Slovenije in opozarja na v aprilu 1998 obstoječo neustrezno sistemsko zakonodajo. Predlaga poenotenje organiziranosti po Zakonu o varstvu pred naravnimi in drugimi nesrečami in Zakonu o zdravstveni dejavnosti ter združitev nujne medicinske pomoči in reševalne službe, organizirane znotraj Gorske reševalne službe Slovenije v enotno organizacijo. V nadaljevanju prispevek obravnava odgovornost Gorske reševalne službe Slovenije oziroma države za škodo, povzročeno tretji osebi, in odgovornost za škodo, ki jo pri opravljanju nalog Gorske reševalne službe utrpi njen udeleženec. Poziva k enotni organiziranosti, opozarja na nujnost natančne določitve nalog delovanja Gorske reševalne službe Slovenije v izvrševanju javnopravnih pooblastil. Predlaga jamčevanje države brez omejevanja na hujšo obliko krivde za škodo, povzročeno tretjim osebam, in izenačenje odgovornosti države na način, kot velja za delavce v državnih organih pri izvrševanju javnopravnih pooblastil. Zavzema se za objektivno odgovornost Gorske reševalne službe Slovenije in države za škodo, ki jo utrpijo sami udeleženci.
