Abstract     Introduction. Noncompetent medical assessments require through analysis of their causes. Insufficient expert and practical knowledge of the authors could lead to errors in courts as well as insurance companies at defining justifiel refunds for injuries. Methods. Analysis of 8000 expert medical assessment was made, that were used in refund procedures of Zavarovalnica Maribor, focusing on most common deviations from normal assessment rules in structure and content. The following criteria were observed: specialization of the assessor, medical documents that were studied, statements of the mechanisms of injury, expert discussion, cause-effect relationship proof, insurance contracts consideration and permanent loss of life activities at minor injuries. Conclusions. There was a 10-80% interval in those derivations. The most common errors were due to modern medical and assessment literature not taken into consideration, partial study of medical documentation, lack of knowledge of injury biomechanics, unobjective presentation of subjective complaints of the patients and lack of expert and practical traumatological knowledge.
