Abstract | Responsibility of a nurse for health deterioration appears on several levels: moral responsibility, professional deontological responsibility, liability for damages, disciplinary responsibility, and criminal liability. The article presents basic elements of each and relations among them. Circumstances for the existence of criminal liability which is assessed in court and always rises considerable public attention are pointed out. Duties of a nurse, however, are not limited only to the nursing care process itself in the strict sense of the word, but also refer to the protection of professional secret. This duty is determined by ethical rules and legal regulations. However, their analysis reveals that in certain circumstances it is the nurse/nursing profession who is left to distinguish between what is legal and what is right. | |
Summary | Odgovornost medicinske sestre za poslabšanje zdravja lahko razdelimo na več nivojev: moralna, poklicno-deontološka, odškodninska, disciplinska in kazenska. V prispevku so prikazani osnovni elementi vsake od njih in razmerje med njimi. Poseben poudarek je dan pogojem za obstoj kazenske odgovornosti, ki jo ugotavlja sodišče v kazenskem postopku in je v javnosti vedno zelo odmevna. Dolžnostno ravnanje medicinske sestre pa ne zajema samo področja zdravstvene nege v ožjem smislu, ampak tudi dolžnost varovanja poklicne skrivnosti. K tej dolžnosti jo zavezujejo etična pravila in pravni predpisi. Njihova analiza pa pokaže, da v določenih situacijah prepuščajo medicinski sestri oziroma zdravstveni stroki odločitev, kaj je pravo in kaj je prav. | |
