Abstract     The problem of drugs and medication in traffic is dealt with in situations of assessing the actual capability of a person for safe driving in a ceratin moment, for example during a traffic accident or police check ... as well as during a medical check-up, required for obtaining a driver's licence. Apart from those who are driving under the influence of illegal drugs, in recent years a growing problem is also the participation of drivers, who are undergoing a methadone maintenance therapy. With the aim of easing the problems in the field of use and abuse of drugs, the state has adopted appropriate measures as far as legislation is concerned, Driving under the influence of drugs, psychoactive medication or other psychoactive substances, which reduce the driving capability is illegal. When studying the occurrenve and prevention the key question of traffic safety and drug remains how to provide the minimun possible risk, which is represented by the use of drugs and psyhoactive substances with participants in traffic. With the help of interdisciplinary studies, criteria for medical selection could be provided by monitoring the occurrence of such drivers during several years as well as follow-up of the success of these drivers, who despite the undergoing medication with psychoactive substances would be allowed to drive. Implementation of such measures in the industrialised world should be taken as an example. By more appropriate legislation in this field we would like to ensure the participation of only those drivers, whose psychophysical capabilities meet the criteria of doctrinally adopted selection or do not represent a risk for the safety in road traffic. Participation of those individuals, who fail to meet these criteria and/or take illegal drugs and other psychoactive substances or medication, which have an impact on their driving capability, is not premitted.
