Abstract     Human conduct has to fulfill certain criteria to be deemed relevant for criminal law. On the European continent these criteria are joined in three large groups called the elements of the general notion of criminal offence. These are: fulfillment of the core of criminalization, unlawfulness and culpability. When in case of resuscitation of a patient criminal liability of a medical practitioner for his or her breach of code of professional conduct is put into question, it has to be carefully and in clue order considered whether each of the elements is fulfilled.
